Seth might have copies of them but he doesn't necessarily own them. When developing DinkHD he got him to come back and do the interface graphics which included re-rendering the original title logo. It is quite possible that Seth has copies of all the 3DS Max files, but that he has to get permission before using them or something like that.
I found a ten year old thread on the RTSoft forums where Seth gives his reason for not wanting to release the 3DS Max models. His response made sense at the time, but it's pretty obvious by now that he's never going to use them again.
