You're right of course, but even the notoriously litigious RIAA doesn't seem to bother with midis. I suppose if you used them in a commercial product you might get some trouble. But I'm sure most D-Mods of any any size include midis that are less than 100% legal.
Edit: To clarify lots of D-Mods use MIDIs of popular songs, which seems to be tolerated, but you're still not allowed to submit MIDIs alone unless you made them yourself.

From my own experience, I know that The Dink Network doesn't approve other than self-created MIDIs. At least, that's how it used to be about 5 years ago.

I completely agree with this statement, as someone who has remade countless songs from rock bands in MIDI form, but I agree with scratcher more. If you make original stuff we'll love you twice as much.
