It can be illegal, depending on if the copyrights are still there, the original company still exists, or if they released it as freeware anyway. Games like Monkey Island are old, but Lucasarts still hold the copyright and even still sell it in their online shop, so that would be illegal.
However, trying to sue everyone spreading around these old games is nearly impossible and would cost a LOT. Hence the reason a lot of companies don't do too much about it.
