Never underestimate the power of a smiley. Smileys are probably the strongest tools you can use for expressing emotions. If you have something serious to say you should be really careful about using smileys. Using the evil smiley after a sentence like 'please don't hold it against me in future.' suggests that if I do hold it against you this will mean that you will get back at me. That's not an apology, that's a threat.

In the mean time, hold Striker's advice in the first guideline of the Dinknetwork in mind: Don't take things to personal, it usually ends up with someone in tears.
