Smarties are from Nestlé, who also make KitKat, Perrier and Nescafé (and lots of other stuff) while M&M's are produced by Master Foods, the conglomorate who gave you Mars, Snickers and more things than you can imagine
The only difference I see between then is the "m" and smarties has more different colors (like purple
But! Here comes the kicker, Smarties is ALSO the brand name for another type of candy (I didn't know that till just now) from Ce De Candy Inc. (www.smarties.com).. this might be cause of confusion here
