It's open source, but not public domain.
The license for the official Dink game source code can be found here: https://github.com/SethRobinson/RTDink/blob/master/LICENSE.md
The graphics and audio assets are not under this license however. You can use them in DMODs and Dink related stuff freely though.
Edit: I should mention there are other Dink engine ports out there too, like FreeDink and YeOldeDink, which are under GNU GPL licenses...
