No, killing them is fine. When I talked to one of the guards in the prisons screen, lots of stuff happened. If it doesn't happen for you, perhaps you need to do something else first. I wouldn't know what, though.
Guards shouldn't say "looks weak". Perhaps you're talking to a fence instead of a guard?
